1. Agreement to these terms
These Terms and Conditions (“Terms”) govern your access to and use of the website (the “Site”) and any content, functionality, and services offered on or through it, operated by FAKTORY44 LLC, a limited liability company formed under the laws of the State of Wyoming, United States (“FAKTORY44,” “we,” “us,” or “our”).
By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
2. Definitions
“Content” means all text, graphics, images, logos, software, and other material on the Site. “You” or “user” means any person who accesses or uses the Site.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Site. By using the Site you represent that you meet these requirements.
4. Use of the Site
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:
- use the Site in any way that violates applicable law or regulation;
- attempt to gain unauthorized access to the Site, its servers, or any connected systems;
- introduce malware or any other malicious or harmful code;
- scrape, harvest, or collect information about other users;
- interfere with or disrupt the operation, security, or availability of the Site; or
- use the Site to transmit unsolicited advertising or infringing, defamatory, or otherwise unlawful material.
5. Intellectual property
The Site and its Content are owned by FAKTORY44 LLC or its licensors and are protected by copyright, trademark, and other intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for your personal or internal business purposes. You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Content without our prior written consent. “FAKTORY44” and our logos are our trademarks and may not be used without permission.
6. User submissions
If you submit information or materials to us (for example, through our contact form), you represent that you have the right to do so, and you grant us a non-exclusive, worldwide, royalty-free license to use that material for the purpose of responding to you and providing our services. Do not submit confidential information through the Site that you do not wish us to receive on this basis.
7. Services
FAKTORY44 provides creative, design, marketing, and AI consulting services, mobile application development, and digital publishing. The Site itself is primarily informational. Any specific engagement is governed by a separate written agreement or statement of work between you and FAKTORY44; in the event of a conflict between such an agreement and these Terms, the separate agreement controls with respect to that engagement.
8. Third-party platforms, products, and links
Products or services we make available through third-party platforms — including, without limitation, the Apple App Store, Google Play, and Amazon — and any other FAKTORY44-operated property are governed by the terms, conditions, and refund policies of those platforms or properties. The Site may also link to third-party websites we do not control; we are not responsible for their content or practices.
9. Payments, fees, refunds, and cancellations
Where you purchase a product or service directly from us, the applicable price, payment terms, and any refund or cancellation terms will be presented to you at the time of purchase. Payments are processed by our third-party payment processor, Stripe; by making a payment you also agree to Stripe’s terms. For purchases made through third-party platforms, those platforms’ payment and refund policies apply. Except as required by mandatory applicable law, fees already paid are non-refundable unless otherwise stated at the time of purchase or in a separate written agreement.
10. Disclaimers
The Site and its Content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any information on the Site is accurate, complete, or current. Nothing on the Site constitutes legal, financial, tax, or professional advice.
11. Limitation of liability
To the maximum extent permitted by applicable law, FAKTORY44 LLC and its members, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of (or inability to use) the Site, even if advised of the possibility of such damages. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Site will not exceed one hundred U.S. dollars (USD 100). Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
12. Indemnification
You agree to indemnify and hold harmless FAKTORY44 LLC and its members, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your misuse of the Site or your violation of these Terms or applicable law.

14. Term and termination
These Terms remain in effect while you use the Site. We may suspend or terminate your access to the Site at any time, without notice, if we believe you have violated these Terms or applicable law. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.
15. Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Subject to the paragraph below, you agree that the state and federal courts located in Wyoming will have exclusive jurisdiction and venue over any such dispute. Before filing any claim, you agree to first contact us at so we can try to resolve the matter informally.
If you are a consumer resident in the European Economic Area or the United Kingdom, nothing in this Section deprives you of the protection of the mandatory consumer-protection laws of your country of residence, and you may also be entitled to bring proceedings in your local courts.
16. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
17. Miscellaneous
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy and any separate written agreement for services, constitute the entire agreement between you and FAKTORY44 regarding the Site. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We are not liable for any delay or failure to perform caused by events beyond our reasonable control.
